If a client requires a Non-Disclosure Agreement (NDA), Evalant Media will comply fully. In such cases:

* We will not showcase or mention the project in any form (e.g., portfolio, social media, case studies).

* We will handle all project data and communications with strict confidentiality.

* Any promotional use of the project requires written approval from the client.

4. Client Responsibilities

Clients are responsible for:

* Providing timely and accurate information necessary for project completion.

* Ensuring all materials provided to Evalant Media do not infringe on third-party rights.

* Approving deliverables in a timely manner.

5. Payments and Billing

* Payment terms are agreed upon prior to project commencement.

* Late payments may incur additional charges or result in service delays.

* Evalant Media retains ownership of work until full payment is received.

6. Intellectual Property

* Upon full payment, clients receive ownership or licensed usage of the final deliverables as specified in the agreement.

* Evalant Media retains rights to any pre-existing intellectual property or tools used to build the project.

7. Revisions and Approvals

* Projects typically include a limited number of revision rounds as stated in the proposal.

* Additional revisions may incur extra fees.

* Final approval of a project release is the client’s responsibility.

8. Termination

Either party may terminate the agreement with written notice. Upon termination:

* The client is responsible for payment for all work completed up to the date of termination.

* Evalant Media will deliver any completed work upon final payment.

9. Limitation of Liability

Evalant Media is not liable for:

* Any indirect, incidental, or consequential damages resulting from service use.

* Loss of profits, data, or reputation due to delays, errors, or service interruptions.

10. Third-Party Services

Evalant Media may use third-party tools or integrations. We are not responsible for the performance, reliability, or legal compliance of such services.

11. Portfolio Rights

Unless an NDA is in place, Evalant Media reserves the right to showcase completed projects for promotional purposes, including on our website and marketing materials.

12. Modifications

Evalant Media may update these Terms and Conditions at any time. Continued use of our services implies acceptance of the revised terms.

13. Governing Law

These Terms and Conditions are governed by the laws of the Czech Republic (or specify your jurisdiction if different). Any disputes will be resolved in the appropriate courts of that jurisdiction.
